California Firearms Manufacturing Crimes Notice
Effective January 1, 2026
Subject to certain exceptions, California Civil Code section 3273.51 requires licensed firearms dealers and other licensed or unlicensed firearm industry members to comply with consumer notice, age verification, and identification requirements prior to completing the sale or delivery of certain firearm-related products or items to a purchaser who is in California or a California resident. These requirements apply to the sale or delivery of a firearm barrel unattached to a firearm, and to the sale or delivery of a firearm accessory or firearm manufacturing machine (as defined in Civil Code section 3272.50).Â
To comply with the notice and acknowledgment of notice requirements at Civil Code section 3273.51, subdivision (e)(1 )(A), and (8), a firearm industry member shall, prior to sale or delivery:Â
- Provide a perspective purchaser with a clear and conspicuous notice of the information listed in Civil Code section 3273.51, subdivision (e)(2), notifying the prospective purchaser that it is generally a crime under California law to engage in specified conduct without a valid license to manufacture firearms.
- Receive an acknowledgment from the prospective purchaser attesting that the prospective purchaser received and understands the information in the notice.Â
This requirement seeks to ensure that firearms are manufactured lawfully and that consumers purchasing firearm barrels, firearm manufacturing machines, and firearm accessories, including products “clearly designed and intended for use in manufacturing firearms,” are fairly informed about laws governing their use.Â
This BOF 146 Form may be used to satisfy this notice and acknowledgment of notice requirements under Civil Code section 3273.51, subdivision (e).Â
NOTICE TO PERSPECTIVE PURCHASERSÂ
Pursuant to the California Penal Code, it is generally a crime in California to engage in any of the following conduct without a valid license to manufacture firearms:Â
- Manufacturing more than three firearms per calendar year in California.Â
- Manufacturing a firearm using a three-dimensional printer or CNC milling machine.Â
- Manufacturing a firearm for the purpose of selling or transferring ownership of that firearm to another individual who is not licensed to manufacture firearms.Â
- Manufacturing a firearm for the purpose of selling, loaning, or transferring that firearm, with the intent to complete the sale, loan, or transfer without a required background check initiated by a licensed firearms dealer.Â
- Allowing, facilitating, aiding, or abetting the manufacture of a firearm by a person who is legally prohibited from possessing firearms.Â
- Manufacturing, or causing the manufacture of assault weapons, machineguns, undetectable firearms, unserialized firearms, unsafe handguns that are not on the Department of Justice roster of handguns certified for sale in California, or other generally prohibited weapons.
